Of Counsel Kathleen Cashman-Kramer authored a case summary titled, “Berkley v. Burchard (In re Berkley) (9th Cir. BAP) which was published in the Insolvency Law Committee E-Bulletin by the Business Law Section of the California Lawyers Association (CLA). The article was written by Ms. Cashman-Kramer with editorial contributions from Insolvency Law Committee members Summer Shaw and Hon. Meredith Jury (ret.).

In the article, Ms. Cashman-Kramer analyzes the case Berkley v. Burchard where the Ninth Circuit Bankruptcy Appellate Panel (“BAP”) published a decision confirming a well-settled area of Chapter 13 case law, to clarify an issue regarding increases in a Chapter 13 debtor’s post-confirmation compensation. She further explains that BAP also affirmed a decision of the Northern District of California bankruptcy court granting the Chapter 13 trustee’s motion to modify the debtor’s Chapter 13 plan to capture sufficient funds from a $3.8 million payment received by the debtor in order to pay all of the Chapter 13 creditors in full.
