Of Counsel Kathleen Cashman-Kramer authored an article titled, “BAP Rules “Mere Presence” of Marijuana Near Bankruptcy Case Not Sufficient for Dismissal” which was published in the Business Law Section eNews (June 2020) by the California Lawyers Association (CLA).

In the article, Ms. Cashman-Kramer analyzes the affirmation by the U.S. Bankruptcy Appellate Panel for the Ninth Circuit (“BAP”) of a bankruptcy court’s dismissal of a Chapter 13 case filed by Brigham and Carly Rae Burton (the “Burtons”). The Burtons owned the majority interest in Agricann, LLC (“Agricann”), an entity that was engaged in cultivating and selling marijuana – an action that is illegal under the federal Controlled Substances Act, 21 U.S.C. sections 801 et seq., in particular, section 841(a). The article was written by Ms. Cashman-Kramer with editorial contributions from Sullivan Hill Shareholder Gary Rudolph and Maggie E. Schroedter, Esq. at Higgs Fletcher & Mack, LLP.
