Sullivan Hill’s Elizabeth Stephens authors an article published by the American Bankruptcy Institute Journal titled, “Key Bankruptcy Legislation Sent to the House Floor.” In the article, Ms. Stephens discusses three significant legislation bills that have been sent to the House floor and, if enacted, could have a dramatic effect on the Bankruptcy Code and bankruptcy practice, especially consumer bankruptcy practice. The bills that are being considered are the Student Borrower Relief Act of 2019, Protecting Homeowners in Bankruptcy Act, and Protecting Employees and Retirees in Business Bankruptcies Act of 2020.

“The Student Borrower Relief Act of 2019 would strike § 523(a)(8) from the Bankruptcy Code. Next, the Protecting Homeowners in Bankruptcy Act would increase the federal homestead exemption. Finally, the Protecting Employees and Retirees in Business Bankruptcies Act of 2020 would expand protections in chapter 11 for employees and retirees while placing additional restrictions on the compensation of executives,” states Ms. Stephens. In the article, she explains each bill in more detail and how they would affect the Bankruptcy Code if enacted.
