Of Counsel Elizabeth Stephens was interviewed by Law360 for their article titled, “Washington Policy Rush Could Crowd Out Bankruptcy Reform.” The article discusses how long desired reforms in the bankruptcy code regarding venue and executive bonuses will most likely be further delayed by the new Congress and Biden administration as the primary focus is on the on-going effects of the COVID-19 pandemic. However, the article also states that many bankruptcy professionals, including Ms. Stephens, agree that smaller changes to the bankruptcy rules and procedures are still possible.

The article notes Ms. Stephens’ opinion that “those in Washington who wish to pursue bankruptcy reform would do better to propose some of the incremental changes that have been floating around the halls of Congress for several years.” Furthermore, Ms. Stephens stated, “‘It seems to me the smart thing to do, since Congress is going to be so busy for the next 100 days at least, if you were interested in testing the waters, take one of the more innocuous bills and see how that goes with the new Congress and the president.'”
